The Supreme Court in Endrew F. v. Douglas Cty. Sch. Dist. RE-1, 137 S. Ct. 988 (2017) made clear that the IEPs of children with disabilities must be “appropriately ambitious” to enable them to make progress in the general education curriculum in light of their unique abilities.    The Court explained that children with disabilities are to be challenged to reach their potential progress just as their non-disabled peers are.  For most students, this progress happens most effectively when children with disabilities are given access to the general education curriculum and included in the general education classrooms with their peers without disabilities. IEPs that are just deemed to be “more appropriate” without regard to the children’s least restrictive environment do not provide children with the ability to meet their true potential, nor do they satisfy the Congressional mandate under IDEA. How does this happen at the IEP table? What are the questions to ask when measuring progress? A parent attorney will give examples and real-life application to these questions.

  • Biography Perry A. Zirkel is university professor emeritus of education and law at Lehigh University, where he formerly was dean of the College of Education, subsequently held the Iacocca Chair in Education for its five-year term, and continues to co-direct the Lehigh Special Education Law Symposium. He has a Ph.D. in Educational Administration and a J.D. from the University of Connecticut, and a Master of Laws degree from Yale University. He has done presentations in every state in the U.S. He has written more than 1,550 publications on various aspects of school law, with an emphasis on legal issues in special education. He writes a regular column for Exceptionality journal, NAESP’s Principal magazine and NASP’s Communiqué newsletter, and he did so previously for Phi Delta Kappan and Teaching Exceptional Children. Past president of the Education Law Association and co-chair of the Pennsylvania special education appeals panel from 1990 to 2007, he is the author of the CEC monograph The Legal Meaning of Specific Learning Disability; the more recently published books, A Digest of Supreme Court Decisions Affecting Education and Student Teaching and the Law; and the two-volume reference Section 504, the ADA and the Schools, now in its fourth edition. In 2012, he received the Research into Practice Award from the American Educational Research Association (AERA) and the Excellence in Research Award from AERA’s Division A (Administration, Organization & Leadership). In 2013, he received the University Council for Educational Administration’s Edwin Bridges award for significant contributions to the preparation and development of school leaders. In 2016, he received the Education Law Association’s Steven S. Goldberg Award for Distinguished Scholarship in Education Law, and in 2017 he received the Council for Exceptional Children’s Special Education Research Award.

IDEA mandates the use of positive behavioral supports where a child’s behavior impedes the child’s learning. The development of behavioral intervention services stem from a Functional Behavior Assessment (FBA) . Based upon the results of the FBA, a school district creates a BIP, which is a plan designed to manage the interfering behaviors.  The BIP develops strategies to address these behaviors based upon the FBAs analysis as to why the student exhibits the behaviors. Thus, the creation of the BIP is dependent upon the FBA, much as the creation of the IEP is dependent upon evaluations and observations. The FBA and BIP assist parents and school officials at IEP meetings to select interventions and strategies that directly address the problem behavior. Lack of appropriate FBAs and BIPs lead to unnecessary discipline issues in schools. A parent side attorney will discuss the importance of FBAs and BIPs and the discipline issues that may arise from a lack of support.

The development of behavioral intervention services stem from a Functional Behavior Assessment (FBA) . Based upon the results of the FBA, a school district creates a BIP, which is a plan designed to manage the interfering behaviors.  The BIP develops strategies to address these behaviors based upon the FBAs analysis as to why the student exhibits the behaviors. Thus, the creation of the BIP is dependent upon the FBA, much as the creation of the IEP is dependent upon evaluations and observations. The FBA and BIP assist parents and school officials at IEP meetings to select interventions and strategies that directly address the problem behavior. Lack of appropriate FBAs and BIPs lead to unnecessary discipline issues in schools. A parent side attorney will discuss the importance of FBAs and BIPs and the discipline issues that may arise from a lack of support.
