The Four Faces of FAPE: The Latest Developments

This session will enumerate and explain each of the successively evolving “faces,” or dimensions, of the core IDEA requirement for “free appropriate public education” (FAPE): (1) procedural, (2) substantive, (3) failure to implement, and (4) capable of implementing.  For each face, the presentation will provide the current legal status in the adjudicative analyses for denial of FAPE, along with illustrative case citations.  The presentation will also show the corresponding but different standards upon viewing these four claims via the lenses of the complaint investigation process and the local professional norms.
